Who these terms are between
These terms are an agreement between you — the creator running a scan — and Abscissa AI LLP, a limited liability partnership registered in India (LLPIN ACS-9875), registered office at 130, 3rd Floor, Right Side, Kirti Nagar, New Delhi, West Delhi, Delhi, India – 110015. "We" means Abscissa AI LLP; "you" means the person using Who's Paying.
You accept these terms when you run a scan on Who's Paying, when you create an account, and again each time you subscribe, buy credits or unlock a brand. If you do not accept them, do not use the service. Read them with our Privacy Policy, Data Sources and Data Removal pages.
Eligibility
To use Who's Paying you must:
- be 18 years of age or older;
- be in India, and be using the service for your own creator work in India;
- hold a Who's Paying account registered to an email address you control, if you are paying for anything; and
- be able to enter into a contract under Indian law.
Your account is personal to you. Do not share your sign-in, sell your account or pass it on. If an account is shared, we may suspend it without notice.
What Who's Paying does — and what it does not do
Who's Paying reads your public Instagram profile and recent public posts, transcribes the audio of a few public reels, searches the public Meta Ad Library for brands running ads in India in your topic space, and produces a report: brand matches with their evidence, an indicative rate card in Indian rupees, and draft pitch messages you can send yourself.
Scanning is free and open to anyone. Sign in to save and use the report. Every brand's name, niche and why it fits you are visible to everyone. Ten credits unlock one brand: its people to write to and a pitch drafted for you. On your own report, the best-fit brand that has a contact on file is open free. For a brand with nobody on file yet, unlocking starts a search for the right person: you are charged only if we find someone; if we find nobody, or cannot confirm the brand's website to search, the brand opens free with its pitch and nothing is charged. A search usually finishes within a minute or two and may finish after you leave the page, in which case the brand opens, and is charged, when it does. Bought credits do not expire, and brand unlocks are permanent.
We never ask you to log in to Instagram — no Instagram login, no OAuth, no Instagram password, and no access to your account there. Your Who's Paying account is our own and has nothing to do with Instagram. Data Sources sets out where each piece of data comes from.
What Who's Paying does not do, and never promises:
- It does not guarantee that you will get a brand deal.
- It does not guarantee that any brand will reply, or even read your message.
- It does not guarantee any income, fee or uplift in your earnings.
- It does not guarantee a minimum number of brand matches. A scan can honestly return few, or none.
- It does not guarantee that any rate in the report is what a brand will pay you.
- It does not contact any brand for you. We never send a message on your behalf.
- It is not legal, tax, financial or business advice. What you do with the report is your decision.
Who's Paying is not affiliated with, endorsed by, sponsored by or partnered with Meta Platforms, Instagram, or any brand, agency or advertiser named in a report. We read public data from public sources and third-party data providers. We claim no permission or licence from Meta or Instagram.
Your account and access
You do not need an account to run a scan. You do need one to pay for anything and to unlock a brand, because credits and unlocks have to belong to somebody.
Sign-in is handled for us by Clerk, our identity provider; we never see or store your password. Your credit balance, the expiry date on each part of it, and every brand you have unlocked belong to that account, so signing in on another device brings them with you.
What you unlocked is readable only by your account. Handing someone the link does not show them what you paid to see.
Features can change or disappear as the product develops. Where a change materially reduces what a credit buys, we will say so before it takes effect — and where it changes the price, the size of an allowance or the expiry, we will tell you before the change reaches a renewal.
What a credit is, and what an unlock is
Running a scan costs you nothing and spends no credit. Credits are spent on three things: unlocking a brand, a premium media kit, and a media kit stats refresh. Ten credits unlock one brand. A premium media kit costs ten credits once for each Instagram handle, and a stats refresh costs ten credits each time; a refresh that fails is refunded. An active subscription includes the premium media kit and one stats refresh a month.
An unlock is permanent, and it is attached to your account and that brand — not to the scan it came out of. Re-scan the same handle next month and every brand you have already unlocked is still open, at no further charge. You only ever pay for brands that are new to you.
Subscription, top-ups and payment
Credits reach your account three ways.
- A subscription. Each cycle grants an allowance on the day it is charged — 250 credits on the monthly plan, 750 on the three-month plan. Credits granted by a subscription expire at the end of the cycle that granted them. They do not roll over, and an expired credit is not refunded. The next cycle grants a fresh allowance rather than adding to the old one.
- A credit pack, a fixed number of credits bought outright for one payment, with no subscription needed. Pack credits never expire.
- A top-up, available while you hold a subscription, bought outright at a fixed price per credit with a minimum of ten credits in one purchase. Top-up credits never expire. Neither do credits from a coupon or a referral.
Prices are shown in Indian rupees on the checkout page, 18% GST is added, and the GST-inclusive figure is the amount charged. Payment is taken by Razorpay, our payment processor — we never see or store your full card details.
Auto-renewal and cancellation
A subscription renews automatically and charges you again until you cancel it. It runs on a UPI Autopay or card mandate you approve at checkout: every month on the monthly plan, every three months on the three-month plan, at the same GST-inclusive amount each time. This is stated on the checkout page before you can pay, not only here.
You can cancel at any time, by email to raghav@ostryaai.com or by revoking the mandate in your bank or UPI app. Cancelling stops the next charge. It does not refund the cycle you are already in, it does not end that cycle early, and it does not close the brands you have unlocked — those stay open whether or not you are still subscribed.
The first 100 paying creators hold a founder price for as long as their subscription stays active; after that the standard price applies. Cancel, and the founder price is not held for you.
The full position — the expiry, the renewal, how to cancel, and every refund we do and do not give — is in Refunds and Cancellations.
Your responsibilities
You agree that:
- You submit only your own Instagram handle, unless you are authorised to submit someone else's — for example, you manage that account. Submitting a handle you had no right to submit is your breach, and the person concerned can have the data removed through Data Removal.
- You will not harass, stalk, dox or intimidate anyone, including a brand employee whose work email appears in a report.
- No automated access. No scraping the service at scale, no bots or scripts triggering scans, no getting around rate limits, the sign-in gate or any other technical control.
- You will not resell, sublicense or republish reports as a product or service to others.
- You will not use Who's Paying output to build or train a competing dataset, index, database or model.
- You will not misuse the service — no attempts to break it, probe it, overload it, or reach another scan's data.
Breaking any of these lets us suspend your access immediately.
Media kits
A media kit is a page about an Instagram account, built from the same public numbers as its scan and the details you add. You may publish a media kit only for your own Instagram account, or for an account you are authorised to represent. Before a kit is first published you confirm that in a checkbox — "I am @handle or an authorised representative of this account" — and we record who confirmed it, for which account, the wording you agreed to, and when. We ask once for each kit, and again if that wording changes. Publishing a kit for an account you have no right to represent is your breach of these terms.
A published kit is reachable by anyone who has its link; it is not listed in search engines. You can unpublish it or replace its link at any time, and the old link stops working. We may take a kit down without notice if we receive a credible report that it misrepresents someone, and a kit that has been taken down cannot be published again.
The audience numbers you upload from your own Insights screenshots are yours: we show them as supplied by you, and you are responsible for them being accurate.
You may upload your own photos into a media kit. Upload only photos you own or have the right to use, and that show no one who has not agreed to appear in them. You keep the rights in your photos and give us only the permission we need to store them, resize them and show them on the kits you publish. A photo that infringes someone's rights, or is sexual, violent or hateful, is your breach of these terms; we may remove it, or take the kit down, on a credible report.
Ownership
Abscissa AI LLP owns Who's Paying — the software, the matching and scoring method, the prompts, the report format, and everything on creators.ostryaai.com that we created. Nothing here transfers that to you: you get permission to use the service, not to own or copy any part of it.
Your report is yours to use. You may freely read, keep, adapt, quote and share your own report — including the pitch drafts — for your own commercial outreach to brands, with no fee, credit or permission owed to us. The only limit is the one above: do not turn reports into a product you sell, or into a dataset for a competing service.
Third-party content
A report quotes real material from the public Meta Ad Library and from public Instagram posts: ad copy, brand names, product names and trade marks. All of it belongs to the brands and people who own it — not to us, not to you. We quote it as factual evidence, so you can see which brand is spending on which kind of ad and why a match was made.
Naming a brand to describe a verifiable fact about their public advertising is not a claim of endorsement or approval by that brand. When you reuse this material in your outreach, you are responsible for using it fairly and lawfully.
Accuracy and estimates
Reports are machine-generated: automated systems, including a large language model, classify your content, extract topics, match brands and draft the prose. So:
- Numbers in the report are estimates, not measurements.
- The rate card is an indicative band in Indian rupees — a starting point for a negotiation, not a valuation of you or your business, and not a quote from any brand.
- Verification checks that a citation is real — that the ad, post or page we point to exists and says what we quote. It does not check that our interpretation of that evidence is right.
- A language model can be wrong: it can miss context, misread a niche, or draw a match that makes no sense to you.
Read the report as a research shortcut, not a fact sheet. Check anything you are about to put in front of a brand.
Brand contact details and your outreach
For up to five matched brands, a report may show a business contact email at that brand's company domain, found through a third-party lookup provider. It is there so you can do your own lawful outreach. You agree that:
- You, not Abscissa AI LLP, send every message. We never send any.
- Your outreach will be lawful, honest and relevant to that brand's business.
- You will respect the brand's own stated preferences — if they ask you to stop, stop.
- You will not add these addresses to a bulk mailing list, a marketing tool or an automated sequence, and will not sell, publish or pass them on.
Anyone whose contact details appear in a report can ask us to remove them, unconditionally, through Data Removal.
Service levels
Plainly:
- There is no uptime commitment. The service can be down, slow, or switched off for maintenance. We are a small team and we do not offer an SLA.
- Scans can fail. A provider can time out, rate-limit us or return nothing. We show you the failure rather than hiding it. A failed scan costs you nothing, because scanning is free.
- An unlock that does not open is reversed. If credits were deducted and the brand did not appear, the credits go back to your balance.
- The report format can change. Reports already delivered stay readable, but a later report may not look like an earlier one.
- Reports are not an archive. We keep them so you can come back to them, but keep your own copy of anything you rely on.
Suspension and termination
We may suspend or end your access at any time, with or without notice: if you break these terms, if an account is shared or misused, if the service is abused or overloaded, if a provider or the law requires it, or if we withdraw the service.
If we end your access for a reason that is not your breach of these terms, we cancel the subscription so no further charge is taken, and we refund the unused part of the cycle you had already paid for. If we end it because you broke these terms, we do not, and any credits left on the account lapse with it.
You can stop using Who's Paying whenever you like. To have your data erased, write to raghav@ostryaai.com or follow Data Removal — erasure is done manually by an operator today, so please allow the time set out there.
Ownership, third-party content, limitation of liability, indemnity and governing law survive after your access ends.
Limitation of liability
To the maximum extent Indian law permits:
- Who's Paying is provided as is and as available, with no warranty that it will be accurate, uninterrupted, error-free or fit for a particular purpose.
- We are not liable for lost income, deals, brand relationships, data or goodwill, or any indirect or consequential loss from your use of the service or the report.
- We are not liable for what a brand does after you contact them, or for errors and outages in the third-party sources we depend on.
- Our total liability for all claims is capped at the amount you paid us in the three months before the claim arose.
Nothing here excludes or limits liability that cannot lawfully be excluded under Indian law, including for fraud or for death or personal injury caused by our negligence, and nothing takes away your rights as a consumer under the Consumer Protection Act, 2019.
Indemnity
You agree to indemnify Abscissa AI LLP, its partners and its staff against any claim, loss or reasonable cost arising from: your breach of these terms; a handle you submitted without the right to do so; how you used a report or a brand contact; or your breach of any law or third party's rights.
Changes to these terms
We may update these terms as the product changes. The current version always lives at /legal/terms, with the "last updated" date at the top, and we will flag any change that materially affects your rights. Using Who's Paying after a change means you accept the updated terms.
Governing law and jurisdiction
These terms are governed by the laws of India. The courts at New Delhi have exclusive jurisdiction over any dispute arising out of or connected with these terms or your use of Who's Paying.
